Despite best intentions, disputes can occur. Disagreements can quickly escalate causing major business disruption and cost.
The best time to contact your lawyer is before an issue arises (yes, hindsight can be a beautiful thing). Getting legal advice before venturing off into that new opportunity, whether large or small can save both time and money in the long run. However, planning ahead can remove or at the very least, reduce the risk of fallout from a disagreement if it is dealt with when it first arises.
Defining case outcome objectives and in the first instance, looking beyond the court for potential solutions is, in my view, an extremely productive way of resolving an issue. No business wants to be caught up in a litigious battle.
Occasionally, situations escalate beyond the potential of a resolution outside of court and that’s when a no nonsense approach is needed. Achieving an optimal solution and assisting with the implementation of strategies to prevent future issues is always my number one priority.
I’ve had 38 years of experience in all facets of litigation, predominantly in a commercial context including engineering, mining, building and general business disputes.
